PRESENTATION:  This training is designed for both administrative and clinical staff members interested in enhancing professionalism for all levels of substance use delivery and care through learning and problem solving in response to recent legal trends in governance and compliance. The didactic and shared learning will focus on three ethical topics for substance use providers highlighting current risks in corporate governance, fraud and abuse and privacy. The participants will engage in a didactic session on current legal trends lead by Lucy Hodder, followed by shared learning from group sessions, and practical problem solving identifying key strategies for governance priorities going forward.

As substance use disorder care givers and organizations grow and engage in collaborative care models, governance, financial, and privacy boundaries are challenged.  Promoting good governance is critical for overall sustainability and heightened awareness of best practices at all levels of care delivery. Areas of focus will include key operational and organizational governance concepts, financial boundaries that implicate fraud and abuse rules, and information sharing boundaries that impact patient privacy. Participants will come away with a better understanding of current legal trends posing a risk to substance use delivery models and patient centered care, a shared learning around current experiences of colleagues, and a collective mapping of action steps going forward to enhance governance, professionalism and ethics in integrated and collaborative practice settings.   As a result of attending participants will:  understand the key current legal developments in the area of substance use services delivery around corporate governance, fraud and abuse and privacy in integrated delivery settings; engage in experiential learning discussions focused on case studies raising risk areas of concern around governance, fraud and abuse and privacy; and use collaborative discussion to dispel myths and fears around governance issues and risk areas.

ABOUT THE PRESENTER:  Lucy Hodder, the Director of Health Law and Policy programs at the Institute for Health Policy and Practice and a Professor of Law at UNH School of Law, most recently served as Legal Counsel to New Hampshire Governor Maggie Hassan and as the senior health care policy director. Lucy currently supervises and runs the Certificate in Health Law and Policy program at UNH Law, directs Health Law and Policy research at IHPP and is an experienced New Hampshire health care, regulatory and employment attorney. She was previously a shareholder in the firm of Rath, Young and Pignatelli, PC, and Chair of the firm’s Healthcare Practice Group, and named Lawyer of the Year – 2012 for Health Care Law by her peers. In the 2017-2018 NH legislative cycle Lucy provided technical assistance on SB 549 and has since presented on CAPTA/CARA numerous times.
